Murder:
- kill intentionally and with premeditation; "The mafia boss ordered his enemies murdered"
- unlawful premeditated killing of a human being by a human being
The Wikipedia Encyclopedia defines murder:
- Murder is the unlawful killing of a human person with malice aforethought. Murder is generally distinguished from other forms of homicide by the elements of malice aforethought and the lack of lawful justification.
Manslaughter -
The unlawful killing of a human being without malice or premeditation, either express or implied; distinguished from murder, which requires malicious intent.
The distinctions between manslaughter and murder, consists in the following: In the former, though the act which occasions the death be unlawful, or likely to be attended with bodily mischief, yet the malice, either express or implied, which is the very essence of murder, is presumed to be wanting in manslaughter.
It also differs from murder in this, that there can be no accessaries before the fact, there having been no time for premeditation. Manslaughter is voluntary, when it happens upon a sudden heat; or involuntary, when it takes place in the commission of some unlawful act.
One of the reasons I have put the definitions above is to enlighten the Trinidad and Tobago Police Service aka on this blog as dunceys.
It seems dunceys never think, hence the fact that they are dunceys.
Here we have a woman being charged for attempted murder, when in the heat of a moment she stabbed a man - and clearly the charge should have been voluntary manslaughter.
But over the years I have noticed that dunceys always go for the higher charge, then sometime during the court proceedings the charge will be 'lessened' to manslaughter to get a plea bargain, or to get a guilty verdict.
Surely this is an abuse of the process of law. But again, it is only in Trinidad that dunceys could get away with this shit, which is obviously sanctioned by the idiots at the Magistrates court and the State Solicitors office. (Addendum: Since I posted this blog, I've been told (see comment by Chennette) that it is the DPP's office, not the State Solicitor's that is responsible for directing the laying of charges).
As an aside, I find myself writing so many things about dunceys - not because I want to. But because I started this blog about things that irk me, and they do it more than most, just from the sheer volume of idiotic things they do. Collectively, the entire top brass of the police force from Paul down seem to have the brain of a mollusc, backed by the amoebic intelligence of certain sections of the judiciary.
